Consumer Rights – Withdrawal – Cancellation Return Conditions

GENERAL TERMS:

  1. By placing an order electronically through the website you are using, you are deemed to have accepted the pre-information form and the distance sales contract provided to you.

  2. Buyers are subject to the provisions of Law No. 6502 on the Protection of the Consumer and the Distance Contracts Regulation (Official Gazette: 27.11.2014/29188), as well as other applicable laws regarding the sale and delivery of purchased products.

  3. Shipping costs for product delivery shall be borne by the buyers.

  4. Each purchased product shall be delivered to the person and/or institution at the address specified by the buyer, within the legal period of 30 days. If the product is not delivered within this period, buyers may terminate the contract.

  5. The purchased product must be delivered complete, in accordance with the specifications stated in the order, and accompanied by any applicable documents such as warranty certificates or user manuals.

  6. In the event that the sale of the purchased product becomes impossible, the seller must notify the buyer in writing within 3 days of learning about this situation. The total amount must be refunded to the buyer within 14 days.


IF THE PURCHASED PRODUCT PRICE IS NOT PAID:

  1. If the buyer does not pay for the purchased product or cancels the payment in the bank records, the seller’s obligation to deliver the product ceases.


UNAUTHORIZED USE OF CREDIT CARDS:

  1. If it is determined that the credit card used by the buyer for payment has been used unlawfully by unauthorized persons and the sold product price is not paid to the seller by the relevant bank or financial institution, the buyer is obliged to return the product to the seller within 3 days, with shipping costs covered by the seller.


IF THE PRODUCT CANNOT BE DELIVERED DUE TO UNFORESEEABLE CIRCUMSTANCES:

  1. If force majeure events that the seller could not foresee occur and the product cannot be delivered on time, the buyer will be informed. The buyer may request cancellation of the order, replacement with a similar product, or postponement of delivery until the obstacle is removed. If the buyer cancels the order:

  • If payment was made in cash, the amount will be refunded within 14 days from the date of cancellation.

  • If payment was made by credit card, the amount will be refunded to the bank within 14 days, but the bank may take 2-3 weeks to credit the buyer’s account.


BUYER’S OBLIGATION TO INSPECT THE PRODUCT:

  1. Before accepting the delivery of the contracted goods/services, the buyer must inspect the items and refuse delivery if the goods/services are damaged, dented, broken, or if the packaging is torn. Delivered goods/services are deemed to be received undamaged and intact. After delivery, the buyer must handle the goods/services with care. If the buyer wishes to exercise the right of withdrawal, the goods/services must not be used and must be returned with the invoice.


RIGHT OF WITHDRAWAL:

  1. The buyer may exercise the right of withdrawal within 14 (fourteen) days from the date the product is delivered to themselves or the person/institution at the address they specify, without any legal or penal liability, without giving any reason, by notifying the seller via the contact information below.

WITHDRAWAL PERIOD:

  1. For services purchased, this 14-day period begins from the date the contract is signed. Withdrawal cannot be exercised for service contracts once the service has commenced with the consumer’s consent before the end of the withdrawal period. Notification regarding the right of withdrawal is provided in the Distance Contracts and Cancellation Terms, and the buyer places the order with full awareness of these conditions.

  2. Costs arising from exercising the right of withdrawal shall be borne by the seller.

  3. To exercise the right of withdrawal, the buyer must notify the seller in writing within 14 days via registered mail, fax, email, or other methods specified by the seller, and the product must not be used in accordance with the provisions of the “Products Not Eligible for Withdrawal” in this contract.


EXERCISING THE RIGHT OF WITHDRAWAL:

  1. The invoice of the product delivered to a third party or the buyer must be returned. (If the invoice is issued for a corporate order, the return must include the return invoice issued by the institution; otherwise, the return cannot be completed.)

  2. The return form, the product’s box, packaging, and any standard accessories must be returned complete and undamaged.


RETURN CONDITIONS:

  1. The seller is obliged to refund the total amount and documents putting the buyer under obligation within 10 days of receiving the withdrawal notice and receive the product within 20 days.

  2. If the product’s value decreases due to the buyer’s fault or if the return becomes impossible, the buyer must compensate the seller proportionally. However, the buyer is not responsible for changes or deterioration caused by proper use of the product within the withdrawal period.

  3. If exercising the right of withdrawal reduces the value below a campaign limit, the discount obtained during the campaign will be canceled.


PRODUCTS NOT ELIGIBLE FOR WITHDRAWAL:

  1. Products prepared according to the buyer’s personal requests, underwear, swimwear bottoms, cosmetics, single-use products, perishable items, items where opening the packaging is inappropriate for hygiene, products mixed with others that cannot be separated, periodicals (excluding subscription services), instant digital content, software, books, and other non-tangible goods are not eligible for withdrawal.

  2. Cosmetic and personal care products, underwear, swimwear, books, copyable software and programs, DVDs, VCDs, CDs, cassettes, and stationery consumables (toners, cartridges, ribbons, etc.) must be unopened, unused, and undamaged to be eligible for return.

  3. According to the Distance Contracts Regulation, products not eligible for withdrawal include:

  • Products prepared according to consumer preferences or personal needs.

  • Perishable products or products with a limited shelf life.

  • Products with opened protective packaging not suitable for hygiene.

  • Products mixed with others that cannot be separated.

  • Books, digital content, and computer consumables with opened packaging.

  • Services scheduled for a specific date or period (e.g., accommodation, transport, car rental, food supply, leisure activities).

  • Instant services or intangible goods delivered electronically.


DEFAULT AND LEGAL CONSEQUENCES:

  1. If the buyer makes a credit card payment and defaults, they accept that they will pay interest and be liable to the bank under the credit card agreement. The bank may take legal action, and any resulting costs and attorney fees may be claimed from the buyer. The buyer also agrees to compensate the seller for any damages caused by delayed performance.

  2. Credit card payments can be made online, including single payments or installments. Online payments will be processed at the end of the order, and the amount will be charged to your card.
